OH!ZUZA Gift Card Terms and Conditions

§ 1 Definitions

Statute – specifies the conditions for the purchase and redemption of OH!ZUZA Gift Cards in the online store ohzuza.com

Publisher – The publisher is the owner of the OH!ZUZA night&day brand and the online store ohzuza.com , company Vanilla sc K. Pastwa, M. Pastwa, ul. Struga 78, 90-557 Łódź, NIP 118-184-22-39

Store – online store, run in Polish, under the domain ohzuza.com , run by the Publisher

OH!ZUZA Gift Card or Gift Card or Card – a tool (represented by a numerical code) that authorizes the User to purchase Goods offered in the Store with its use, up to a maximum amount corresponding to the nominal value assigned to a given code. The Gift Card is not an electronic payment instrument, an electronic money instrument or a payment card.

Buyer – an entity that acquires a Gift Card from the Issuer in exchange for providing the Issuer with funds equal to the value of the card. The Purchaser may also acquire the Card free of charge under separate regulations. The Card may be used directly by the Purchaser or another User to whom the purchaser has transferred the Card.

User – The Purchaser or each holder of the Gift Card who uses the Card when shopping in the Store

Goods – All items offered for sale in the Store

Transactions – Purchase and sale agreements concluded between the Publisher and customers via the Store

Basket – a shop subpage where the customer collects products to order

§2

§ 3 Issuance of a Gift Card

  1. The Gift Card can be purchased via the online store ohzuza.com
  2. The Purchaser transfers funds to the Issuer in an amount corresponding to the value of the Gift Card. The amount of funds transferred corresponds to the value of the Gift Card transferred by the Issuer to the Purchaser, and the Issuer uses Gift Cards with a value of: PLN 200, PLN 300, PLN 500, which can only be used in the Store.
  3. The nominal value of the Gift Card is expressed in Polish zloty (PLN).
  4. The Gift Card is activated when the Customer places an order in the Store containing the Gift Card in the shopping cart and pays for it, and sends it to the Purchaser.
  5. The Issuer undertakes to send the Gift Card to the Purchaser to the specified address or by e-mail in electronic form, and then to redeem it in the ohzuza.com store
  6. At the request of the Purchaser, the Issuer issues a non-fiscal document confirming the fact of purchase and the value of the purchased Gift Card. The issuance of a Gift Card to the User does not constitute a sale subject to VAT within the meaning of the relevant tax regulations. The Purchaser has the right to receive a receipt of payment, which is not a fiscal document, as a confirmation of payment of funds. At the time of redemption of the Gift Card by the recipient, fiscal documents are issued (receipt / invoice).
  7. The Buyer or User is entitled to complete the transaction of purchasing any Goods using the Gift Card in the Store during the validity period of the Gift Card.
  8. The Gift Card is valid for 12 months from the date of issue to the Purchaser. After this period, the Gift Card becomes invalid.
  9. If the Issuer implements a campaign to issue Gift Cards with a different activity period, this does not affect the activity period of Gift Cards previously purchased in the store.
  10. The purchase of a Gift Card by the Purchaser constitutes the conclusion of an agreement for the use of the gift card between the Issuer and the Purchaser.

§ 4 Redemption of the Gift Card

  1. The Gift Card enables the User to pay for goods offered exclusively in the Online Store in the domain ohzuza.com
  2. The Gift Card covers the cost of goods selected for the Cart and the cost of shipping the goods within Poland.
  3. The Gift Card is redeemed by entering its number in the appropriate field when summarizing the transaction during shopping.
  4. The User may use the Gift Card multiple times until the funds reflected in its face value are exhausted or its validity period expires.
  5. Payment with a Gift Card is possible only up to the value of the Card held. In the event that the Cart value is higher than the Gift Card value, the User is obliged to pay the difference using any payment method (except for cash on delivery). In the event that the Cart value is lower than the Gift Card value, the User may use the remaining funds during the next transaction in the store (these funds cannot be spent in cash, returned by transfer, etc.).
  6. Purchases made using the Gift Card may be combined with currently available Store discounts.

§5

  1. The Issuer will refuse to redeem the Gift Card ohzuza.com When:
    1. the face value of the Gift Card is exhausted or the Card's validity expires
    2. the funds on the Gift Card are insufficient to purchase the goods added to the Cart by the User, and the User is unable to pay the missing value

§6

  1. The funds on the Gift Card (nominal or current value) are not subject to:
    1. interest rate,
    2. are not refundable to the Buyer or User,
    3. The Gift Card cannot be exchanged for cash and cannot be returned to the Issuer or exchanged for other Issuer vouchers.

§ 7 Product returns

  1. Goods purchased in the online store ohzuza.com using the Gift Card are subject to return under the general principles provided for by law (see Returns and Exchanges ). In the event of a return of goods purchased using a Gift Card, the refund will be made to a new Gift Card.

§ 8 Final provisions

  1. Complaints regarding the issuance, top-up and use of the Gift Card can be reported via the hotline: +48 665 121 500 or by writing to the address shop@ohzuza.com .
  2. The publisher will respond to the complaint within 14 days of its receipt.
  3. By paying funds to the Issuer and receiving the Gift Card, the User declares that he/she is familiar with and understands the provisions of these Regulations and undertakes to comply with them.
  4. The Publisher reserves the right to change the Regulations. In such a case, each Buyer/User will have the opportunity to familiarize themselves with the changes by publishing them publicly on the Store's website ohzuza.com .
  5. The administrator of the personal data of Purchasers and Users processed in connection with the execution of the Gift Card agreement is the Issuer. Personal data is processed for the purpose of the execution of the Gift Card agreement and in accordance with Privacy Policy .
