Oh!Club Terms and Conditions

§1. General provisions

  1. These regulations ("Regulations") define the rules of participation in the Oh!Club loyalty program ("Program") operated by Vanilla sc K.Pastwa, M.Pastwa, ul. Napoleonska 33, 94-231 Łódź, NIP 1181842239 ("Organizer") via the online store operating at ohzuza.com.
  2. The program is aimed at store customers – consumers and entrepreneurs with consumer rights – who have a customer account in the store or make purchases by providing an e-mail address.
  3. Participation in the Program is voluntary and free of charge.
  4. The program is valid from the date of publication of these Regulations on the store's website – until further notice.

§2. Definitions

  1. Participant – a person who has been assigned a customer account in the store and/or who has made a purchase by providing an e-mail address and has been included in the Program.
  2. Oh!Coins – loyalty points awarded to Participants in accordance with the Regulations.
  3. Customer account – the account in your Shopify store (customer account) to which your Oh!Coins balance is associated.
  4. Loyalty system – an external Smile.io application integrated with the store, used to calculate and settle points.

§3. Joining the Program

  1. You can be added to the Program automatically by the Organizer (e.g. based on previous purchases) or by logging in to your customer account and opening the Smile.io program panel (widget).
  2. Participation in the Program does not require separate registration if the customer already has an account in the store or has made a purchase by providing an e-mail address.

§4. Rules for awarding points

  1. For every PLN 1 gross spent in the store, the Participant receives 3 Oh!Coins.
  2. Points are calculated based on the order value after taking into account all discounts, promotional codes and rebates (calculated from the final amount – subtotal).
  3. Points are awarded after the order is posted in the store (status "paid").
  4. For birthdays entered in the customer account at least 30 days in advance, 500 Oh!Coins are awarded – once a year.
  5. Currency conversion: For purchases made in a currency other than PLN (e.g., EUR, GBP, USD), the order value for Oh!Coins calculations is converted based on the PLN order value stored in the store's system. This means that two customers purchasing the same product—one in PLN, the other in a different currency—will receive the same number of Oh!Coins, as the Program is based on the store's base currency (PLN).
  6. The Organizer may temporarily award more points (special promotions, multipliers).

§5. Exchanging points for prizes

  1. The basic exchange rate is: 500 Oh!Coins = 5 PLN discount.
  2. The participant can exchange points in multiples of 500 Oh!Coins (e.g. 1,000 Oh!Coins = PLN 10, 1,500 Oh!Coins = PLN 15), provided the points balance allows it.
  3. The participant can exchange Oh!Coins for percentage discounts according to the table below:

    10% discount 2,700 Oh!Coins 30 PLN

  4. All Oh!Club discounts and rewards can be combined with other store discounts and promotions, unless the specific promotion description states otherwise.
  5. Points are exchanged by generating a reward (code) in the Smile.io system and using it in the cart/checkout.
  6. Points cannot be exchanged for cash or transfer.

§6. Validity of points

  1. Oh!Coins are valid for 12 months from the date they are awarded.
  2. After this period, unused Oh!Coins expire and are automatically deleted from the Participant's account – without any right to compensation.

§7. Returns, Cancellations and Adjustments

  1. In the event of a return of the entire order, the points awarded for that order are automatically deducted from the Participant's account.
  2. In the event of a return of part of the order, points are deducted in proportion to the value of the returned goods.
  3. If the Participant used Oh!Coins from an order that was subsequently returned or refunded, the Organizer has the right to deduct the appropriate number of points from the Participant's account, and if the balance is insufficient, enter a negative balance.
  4. Refunds for orders are made in accordance with the store's regulations, regardless of any activity on the points account.

§8. Communication

  1. The Organizer may send e-mails to Participants regarding point balance, awarded prizes and changes to the Program – also via the Smile.io system.
  2. The participant may unsubscribe from marketing communications, however this may limit the possibility of receiving notifications of awarded prizes.

§9. Personal data

  1. The administrator of the Participants' personal data is the Organizer.
  2. The data is processed for the purpose of implementing the Program (calculating points, sending notifications, handling complaints).
  3. Data may be transferred to the loyalty system provider (Smile.io) – to the extent necessary to implement the Program.
  4. The participant has the rights arising from the GDPR (access, rectification, restriction, objection, complaint to the Personal Data Protection Office).

§10. Complaints

  1. Complaints regarding the Program may be submitted to the e-mail address: [e-mail address here] or in writing to the registered office address of the Organizer.
  2. The complaint should include: name and surname, email address associated with the account, and description of the complaint.
  3. The Organizer will consider complaints within 14 days and inform the Participant about the result via e-mail.

§11. Changes to the Regulations and termination of the Program

  1. The Organizer reserves the right to change the Regulations, in particular in the event of a change in the functionality of the loyalty system, changes in legal regulations or changes in the store's offer.
  2. Participants will be notified of any changes to the Regulations by publishing the new version of the Regulations on the program website. Changes will take effect no earlier than 7 days after publication.
  3. In the event of termination of the Program, Participants will be notified at least 14 days in advance and will be able to use their Oh!Coins during that time.
